1. Information We Collect

We collect the following types of data to provide and improve the Software:

1.1 Personal Information

When you create an account, we may collect:

  • Full name

  • Email address

  • Date of birth (if required for account verification)

  • Password (if applicable)

  • Gender (optional)

1.2 Audio Recordings & Transcriptions

  • When you record audio within the App, the audio file is uploaded to our API for processing. This processing may involve third-party APIs (e.g., OpenAI). After processing, the audio file is deleted from our servers.
  • When audio files or transcriptions are shared with third-party services for processing, they are not linked to your personal data (e.g., name, email, or other identifying information) in any way.
  • The generated transcription is a core component of your created questions. Each question consists of:
    • A question
    • Four possible answers, with one correct answer
    • A true statement that was used to generate the question and answers. The audio transcript is the true statement in this structure.
  • As per Section 5 of the Terms of Service, the transcriptions, questions, and answers are the property of the Company and are not considered the User’s personal data. As a result, these items are not deleted when you delete your account.

1.3 Technical & Usage Data

We collect technical data to ensure app security, improve performance, and troubleshoot issues. This may include:

  • Device information (model, operating system, and version)

  • IP address

  • App usage logs and crash reports

  • Language preferences

The technical and usage data is not connected with your identity in any way.

1.4 Third-Party Services Data

We integrate with third-party APIs (e.g., OpenAI) to provide AI-based features, such as transcribing audio into text and generating MCQs. These third parties may collect and process data according to their own privacy policies.

2. How We Use Your Information

We use the collected data to:

  • Provide and improve the Software’s core functionalities

  • Generate AI-powered questions and quizzes

  • Analyze usage trends to enhance user experience

  • Communicate with you about updates, support, and service notifications

  • Comply with legal obligations

3. Data Sharing and Third-Party Services

3.1 Sharing with Service Providers

We may share some of your data with third-party service providers that assist us in operating our Software, including:

  • OpenAI (for AI-powered transcriptions and quiz generation)

  • Cloud storage providers (to temporarily store transcriptions and recordings)

  • Analytics providers (to track usage trends and improve app performance)

3.2 Compliance with Laws

We may disclose your data if required by law or if we believe it is necessary to:

  • Comply with legal obligations

  • Respond to lawful requests by public authorities

  • Protect our legal rights or prevent fraud

3.3 No Sale of Personal Data

We do not sell or rent your personal information to third parties.

4. Data Retention

4.1 Retention Period

We retain user data for as long as you maintain an active account. If you request account deletion or delete your account using the account deletion feature available in the App, we will remove your data in accordance with our retention policy.

When you delete your account using the account deletion feature in the App:

  • Your personal data (first name, last name, email, date of birth, and gender) is deleted immediately.
  • Your access tokens (if you used Sign In With Google or Apple to create your account) are revoked immediately.
  • While personal data is deleted, anonymized or system backup data may persist indefinitely for security, fraud prevention, and compliance purposes.

This deletion applies only to personal data. As per Section 5 of the Terms of Service, any transcriptions, questions, and answers you created remain the property of the Company and are not removed during account deletion.

4.2 Backup & Archival Data

Some data may be retained in backups for security and compliance reasons. These backups are securely stored and periodically deleted.

4.3 Audio & Transcriptions

Audio recordings are deleted immediately after processing. Transcriptions, which serve as the true statements used to generate questions, are an integral part of the generated content. As per Section 5 of the Terms of Service, transcriptions, along with the generated questions and answers, are the property of the Company and are not considered User data subject to deletion upon account closure.

5. Your Rights & Choices

Depending on your location, you may have the following rights:

5.1 Access & Correction

You can request a copy of your personal data and update incorrect or outdated information. You can make such a request by emailing us at support@quizly.ca.

5.2 Data Deletion

You may delete your personal information anytime by using the account deletion feature in the App. You may also request account deletion by visiting https://quizly.ca/delete-account. Some legal exceptions may apply, and certain non-personal data may be retained as per our Terms of Service.

5.3 Opt-Out of Communications

You can unsubscribe from promotional emails at any time using the opt-out link in our messages.

5.4 Restriction & Objection

Under GDPR and other regulations, you may have the right to restrict or object to certain data processing. However, if such objection or restriction prevents our systems from functioning as intended, we may not be able to provide you with access to the App, and your account may be terminated in accordance with our Terms of Service.

6. Security Measures

We implement industry-standard security measures to protect your data, including:

  • Encryption (to secure data transmissions and storage)

  • Access controls (to limit access to authorized personnel only)

  • Regular security audits (to identify vulnerabilities)

However, no method of transmission over the internet is 100% secure. We encourage users to take steps to protect their personal information.

7. Children's Privacy

The Software is intended for users aged 13 and older. If we discover that a child under 13 has provided personal data, we will delete it immediately. Parents can contact support@quizly.ca to request data removal.

8. International Users

If you access the Software from outside Canada, you acknowledge that your data may be transferred to and processed in Canada or other jurisdictions where our servers are located.

9. Changes to This Privacy Policy

We may update this Privacy Policy periodically. If changes are significant, we will notify you through the App or via email. Continued use of the Software after changes take effect constitutes your acceptance of the revised policy.
